The Federal Motor Carrier Safety Administration (FMCSA) is delaying consideration in an issue involving hazardous materials transportation in the District of Columbia.
FMCSA said it is delaying the American Trucking Associations' (ATA) application in the case "to allow time for appropriate consideration of the issues raised by ATA's application," according to information published in the Federal Register December 21, 2005.
ATA applied for an administrative determination that Federal hazardous material transportation law, 49 USC 5101 et seq, and FMCSA regulations, 49 CFR part 397, preempt routing requirements contained in a regulation established February 1, 2005, by the district.
On May 3, 2005, the US Court of Appeals for the District of Columbia blocked the district from enacting the emergency ban on all rail and truck shipments of hazmat within 2.2 miles of the Capitol.
