FMCSA may amend diabetes rule

The Federal Motor Carrier Safety Administration (FMCSA) is considering amending its medical qualifications standards (49 CFR Part 391) that allows truck drivers with insulin-treated diabetes to obtain exemptions before operating commercial motor vehicles (CMVs).

Upon completion of this rulemaking, drivers with insulin-treated diabetes might not be required to apply for exemptions, according to the advance notice of proposed rulemaking published in the Federal Register March 17.

However, unless and until the agency changes the current standard in this rulemaking, drivers with insulin-treated diabetes are prohibited from operating CMVs in interstate commerce, unless such individuals have exemptions from FMCSA. Comments should be presented before June 15, 2006.
